The contract that ostensibly transferred all risk to the subcontractor was valued in the order of US$100 million.

The key issues at play on this project included:

  • establishing the extent to which acceleration, whether constructive or otherwise, were at play
  • the impact of additional dredging requirements on the time schedule and how these conflated with the subcontractor’s own shortcomings
  • the impact of third-party obstructions
  • extreme weather events
  • unforeseeable ground conditions
  • unavailability of qualifying reclamation material

On such projects, it is crucial to track, record, and communicate contemporaneously, and without fail.
